How Many Lives Did Gun Control Laws Save in Las Vegas? (Answer: Probably Lots)

I’m pro-gun. I say that up front because your beliefs about my intentions will color how you see this post. My intention is to be objective. You can be the judge.

The Vegas gunman used bump stocks on semi-automatic rifles. Those were totally legal. They are also a poor choice of weapons, or so I am told by gun experts. In fact, they are so inaccurate at the distance involved in the Vegas incident that professional snipers say Paddock could have done more damage with a single-shot weapon and some aiming.

The gun experts I talked to (informally) also agree that the shooter would have killed more than a hundred additional people had he used a fully-automatic weapon. You can legally buy an automatic weapon that was made prior to 1986, for about $ 15-20K. The shooter was a millionaire, and he seemed to know a lot about guns. He would have known a fully-automatic rifle is designed to not jam the way his bump stock rifles did. He would have known they fire more bullets per second and more accurately. The death toll would have been much higher had the Vegas gunman used the right weapon.

He knew a fully automatic rifle would be more lethal than a bump stock rifle.

He was rich enough to afford the fully automatic weapon.

He had months to plan and prepare.

He was smart.

And yet he didn’t use a fully-automatic weapon in the attack.

The probable reason is that a fully-automatic weapon is harder to obtain and it raises some flags. I believe even private transactions with those weapons require some government paperwork.

I’m speculating, of course, but it seems to me that the ban on fully-automatic weapons did, over time, create enough friction for the Vegas gunman that he decided to settle for relatively worse weapons.

Ask a gun expert how many more people would be dead if automatic weapons were as easy to procure as bump stocks. My estimate of a hundred extra dead in Vegas is probably low.

Gun control apparently worked in this case, at least to an important degree. The tragedy could have been far bigger. A little bit of friction for obtaining a fully automatic weapon probably saved lives. We can’t know for sure what was in the mind of a madman, but we do know that any kind of friction causes some people to change plans. That’s probably what happened here.

My hypothesis is that crazy people will use whatever weapon is the most effective killing device they can obtain at acceptable cost (friction). Gun laws introduce friction. They are not intended to stop every type of crime or to deter every type of criminal. But it looks like they helped a bit in Vegas. Had there been no friction to procuring fully automatic weapons, it is likely the Vegas gunman would have used them. Why wouldn’t he?

Laws to Stop Marriage Equality Grow Increasingly Weird

Texas is pushing a proposed law that would let the state overrule the Supreme Court. There’s just one problem: they can’t actually do that. Alabama judges have decided that they don’t have to obey federal courts either, except that in reality, they do. And Oklahoma politician wants to switch from marriage licenses to marriage certificates, which would accomplish … not very much.

Let’s start in Texas this week, where first time State Rep Molly White has introduced a bill that would require the state to ignore any Supreme Court ruling that legalized marriage.

Can she do that? Nope, that’s not how laws work. Or the Supreme Court. Or America in general. For better or for worse, Texas is still part of the United States, so Texas can’t just say “no thanks” when the Supreme Court tells them to do something. White’s only been in office for two months, so hopefully she’ll get the hang of it soon.

Over in Alabama, the state Supreme Court is experiencing similar confusion. They’ve ordered probate judges to ignore the federal ruling that they have to issue marriage licenses. So now it’s state law versus federal law, and nobody knows who will win. Just kidding! Federal law will win. That’s the basis of our entire legal system.

Then there’s South Carolina, where a couple of politicians want to amend the US Constitution to ban marriage equality. This has no chance of happening. But State Senator Larry Grooms says that it’s necessary for “the propagation of our species.” Contrary to what Grooms seems to think, reproduction does not, in fact, originate in the U.S. Constitution.

And in Oklahoma, State Rep Todd Ross has solved the marriage debate with a new bill that stops the state from issuing marriage licenses, and instead requires marriage certificates. And this is different because … well, it’s actually pretty much the same, it’s just slightly less paperwork. So, okay.

Finally this week a new national survey shows support for marriage soaring to 59 percent, with just 33 percent opposed. This means that the freedom to marry is slightly more popular than the Pope.

WATCH: A Field Guide to Spotting and Stopping the Homophobic Laws Coming to Your Home State

Don’t look now, but while marriage equality has been spreading across the country, homophobic lawmakers have found a sneaky new way to chip away at civil rights. And not just gay and lesbian civil rights — EVERYONE’S civil rights.

In some cases, they’re passing laws that actually make nondiscrimination against the law. It sounds nuts, but it’s happening right now, and almost nobody’s paying attention.

This is happening because the opponents of marriage equality have finally realized that they’re going to lose. Their backup plan? Pass laws that quietly revoke civil rights across the board, hitting gays and lesbians and everyone else along the way.

In Alabama, for example, Republican State Rep. Mike Ball just proposed HB56, a new law that would allow religious groups to disregard the marriage of any couple they don’t approve of.

He says it’s “not a major change in the law.” But the truth is that it creates a special new license to discriminate. It could be used by hospitals to stop couples from making medical decisions for each other. Or it could force married couples apart at homeless shelters. Mike Ball’s target is probably gay couples, but his law could also be used against interracial couples, or interfaith couples, or anyone with a previous marriage.

Different states are considering over two dozen laws like these around the country. And they’re hard to spot, since they’re usually cloaked in feel-good terms like “religious liberty” or mundane language like “commerce improvement.”

But like the telltale droppings of a rodent infestation, once you know what to look for, you can spot them with ease.

But if you’re in a hurry, here’s what you need to be on the lookout for:

  • Government-Required Discrimination: Laws that require government employees to turn away gay and lesbian couples. Any county clerk who does the right thing and helps an LGBT couple wed will lose their salary and pension.
  • Random Public Discrimination: Imagine if any time you needed a public service, you could be randomly turned away — whether it was riding the bus, asking police for help, or getting a tax refund. These laws let any public employee decide whether or not to help you.
  • Religious Lawbreaking: Some politicians have latched onto a few bakers and florists and photographers who don’t approve of gay and lesbian weddings, and created laws that give those businesses permission to discriminate against LGBTs. But the new exemptions actually go much further, letting any person or business break all kinds of laws, as long as they can claim they’re doing it for religious purposes.
  • Banning Nondiscrimination: This is the most jaw-dropping of all. When these laws pass at the state level, they prohibit towns from providing any new nondiscrimination protection. Once again, LGBTs are the target, but other groups — such as the elderly or veterans — are affected too.

So, obviously, this is a huge looming catastrophe that could do a ton of damage — it’s like the global warming of civil rights.

The good news is that because these laws rely on secrecy, they can be defeated, in part, by exposing their true purpose. I made a second video explaining five simple steps you can take to stop the homophobic backlash:

To sum it up:

  1. Be out. If it’s safe for you to be openly LGBT, do it. And if you’re a straight ally, be out about that too.
  2. Listen to Opponents. When people who oppose nondiscrimination laws talk about things that are important to them (like their job, their home, their marriage, their education, or their family), listen and ask questions.
  3. Tell Your Story. Once you’ve listened to someone talk about the things that matter to them, tell them how you could lose all of those things if these anti-civil-rights laws pass.
  4. Be Vigilant. Watch out for these dangerous laws popping up in your home state. In fact, they may already have been proposed — check the first video above to see if yours is on the map.
  5. Make a Fuss. If a dastardly lawmaker in your state proposes a law like these, don’t let them get away with it. Sound the alarm on social media, make a video about the freedoms you stand to lose, or start a petition.

These tactics were proven to be super-effective with marriage equality, which is why national public opinion has flipped in the span of about a decade.

Homophobic lawmakers know that the tide is turning against them, and these laws are disguised for precisely that reason: their authors know that if people found out what they REALLY do, they’d be a lot less popular.

And that means that discriminatory laws can be defeated, in the same way that marriage bans were defeated. The first step is simply shining a light on them.
