Elon Musk triggered a fraud investigation and a fine from the Securities Exchange Commission after he fired off a tweet that he was going to take his company Tesla public at $ 420 per share. At the time, the tweet was made with his ex-girlfriend Grimes and Azealia Banks in his presence and investors in a lawsuit against him with to subpoena the women but Musk’s legal team is hoping to block the move.

Bloomberg reports:

“It is readily apparent that this is more of an effort to sensationalize these proceedings than a legitimate attempt to preserve evidence,” attorney Dean Kristy said in a filing Thursday in federal court in San Francisco.

The Tesla shareholders say the former girlfriend, Canadian singer Claire Elise Boucher, also known as Grimes, may have first-hand knowledge about what Musk was thinking Aug. 7 when he shocked the world with a tweet: “Am considering taking Tesla private at $ 420. Funding secured.”

The investors claim Musk and Tesla manipulated the company’s share price. They allege Musk lied about funding to push the shares higher and ambush short sellers betting against the company.

The investors cite news media accounts placing Musk in the company of Boucher, and rapper Azealia Banks, around the time of the tweet. They contend it’s not unreasonable to subpoena Boucher and Banks to ensure the preservation of anything in writing that might be relevant to the lawsuit — Twitter and Instagram messages in particular.

Banks responded to news of the filing by Musk’s attorney, writing, “This is going to get extremely ugly” before deleting the post.

Sexual Assault Lawsuit Against Russell Simmons Tossed Out

Russell Simmons can claim a mild victory against the mounting claims that he sexually assaulted a number of women. One woman who made such a claim and filed a lawsuit seeking $ 5 million in damages saw her case dismissed, which sometimes signals something was worked out behind doors.

TMZ reports:

Jennifer Jarosik sued Simmons for millions of dollars, claiming he’d sexually assaulted her after she denied his advances. According to docs, the suit was dismissed Wednesday morning. It was dismissed with prejudice … meaning she can’t refile.

Typically, that’s a sign there’s been a settlement. Reps for Simmons had no comment.

The dismissal comes a couple weeks after Simmons filed a pretty strong response to the lawsuit, claiming Jennifer had sent him text messages and nude photos after the alleged assault.

Despite this positive uptick, Simmons still faces accusations from over a dozen other women.

Maverick Apparel Threatens Lawsuit Against Vlogger Logan Paul

An attorney for New York firm Maverick Apparel LLC has sent a cease-and-desist letter to vlogger Logan Paul for, among other things, trademark infringement.
Paul, who operates his own YouTube channel, has been the target of outrage the past several days after he posted a video of himself in Japan’s Aokigahara forest, a place that’s seen a high rate of suicides. Paul’s YouTube video, which has since been removed, includes footage of himself reacting to what appears to be a victim of suicide. Paul, who commands a subscriber base of 15.4 million through the video-sharing platform, has since publicly apologized for his actions.
Paul’s behavior and use of Maverick is now the subject of a demand letter sent Thursday by Maverick Apparel LLC, which has no affiliation to Maverick by Logan Paul merchandise.
Maverick Apparel, founded in 2005, sells juniors and children’s apparel in the U.S., Canada and Mexico. The company alleges in its letter that its business has taken a hit from confusion in the market by some who believe the two businesses are related.
The letter was sent to Paul and his counsel along with Maverick Media of Beverly Hills. YouTube chief executive officer Susan Wojcicki was also included in the list

Public Enemy’s Flava Flav Files Lawsuit Against Chuck D & Gary G-Wiz

Since the 1980s, pioneering rap crew Public Enemy has remained one of Hip-Hop’s most notable acts and continued their impressive run with an album released this summer. Flava Flav, the hype man to lead rapper Chuck D, has filed a lawsuit against his longtime bandmate for missing royalties over the years.

TMZ reports:

In docs, obtained by TMZ, Flav says he and Chuck have a long-standing agreement to share profits from their music, live concerts and merchandise — but he hasn’t seen a royalty check in several years. Flav says he co-wrote more than 50 of the group’s songs, and he’s especially pissed because Chuck’s still getting paid.

What’s worse … the rapper claims his voice and image were used without his consent on the new PE album, “Nothing Is Quick in the Desert” … released in June. Flav says he requested $ 75k for the record, but only got $ 7,500. He thought he was going to get the remainder later, but it never came.

Flav’s also going after producer Gary G-Wiz for making a deal to create action figures of Public Enemy without his knowledge. In the suit, Flav says Gary got cash from the toy company, but he got zilch.

Gary G-Wiz is a member of the Bomb Squad production crew that helped build the basis of the Public Enemy sound.

Flava Flav is seeking an unspecified amount of damages.

Quincy Jones Wins Lawsuit Against Michael Jackson’s Estate, Awarded $9.4M

Quincy Jones is getting his dough. The iconic musician and composer has won his lawsuit against Michael Jackson’s and has been awarded a cool $ 9.4M. 

The New York Times reports that a Los Angeles jury agreed that Jones has been shortchanged for the use of music he produced in the posthumous Jackson films This Is It and a pair Cirque du Soleil shows.

Interestingly, Jones filed the lawsuit against MJ’s estate in 2013, claiming that he was owed $ 30M. The estate countered that he was owed only $ 392,000 because of an accounting error.

This is where we point out that Thriller, which Jones produced, is the first album to sell 30 million copies. Jones also produced Off The Wall.

“This lawsuit was never about Michael,” said Jones via a statement. “It was about protecting the integrity of the work we all did in the recording studio and the legacy of what we created.”

A$AP Rocky Fires Back At Former Manager With Counter Lawsuit

A$ AP Rocky isn’t keen on settling. Especially in the case of his former manager Geno Sims, who says the Harlem rap star swindling him out of a cool $ 850,000 during the course of their working relationship.

In new documents obtained by The Jasmine Brand, the 27-year-old personality (real name Rakim Mayers) is countersuing Sims, alleging that Sims breached their contract by disclosing information about his finances, personal life and his business to others.

Rocky also attributes any confusion as to what Sims claims he’s owed to the new negotiation they reached when the PMF brought in a second manager circa 2011 to help with his burgeoning celebrity. He says the paperwork filed at the time of Sims’ termination in 2014 explicitly states he wouldn’t be giving him one more red cent.

It appears this issue will be heading to court in the near future.

Women Kicked Off Napa Valley Wine Train File $11 Million Lawsuit [VIDEO]

The so-called loud Black women of the Sistahs on the Reading Edge who were kicked off the Napa Valley Wine Train in August, are looking to get the last laugh.

They recently filed a discrimination lawsuit demanding $ 11 million in damages–$ 1 million for each of the plaintiffs: 10 African-Americans and one white woman.

Reports the Associated Press:

The 11 women sued Napa Valley Wine Train Inc., claiming they were singled out because of race and seeking $ 11 million in damages. The company said in a statement that it takes allegations of discrimination very seriously and has hired a former FBI agent to investigate.

The women said many of them were part of a book club that meets regularly and had gathered on the train to discuss a romance novel. Before the train left the station in Napa, a train employee asked them to quiet down because they were offending other passengers, they said.

The same employee admonished them a second time before telling them that police officers would be waiting for them when the train reached St. Helena, the suit says. They were escorted through several cars as other passengers stared and then off the train and into a dirt lot where police were waiting, according to the suit.

“That was the most humiliating experience that I have ever had in my entire life,” Lisa Johnson, 47, said with tears in her eyes, appearing with some of the other women at a news conference announcing the lawsuit. “This is 2015, and this just cannot happen again.”

The wine train issued an apology after the women were ejected, promising additional training for employees on cultural diversity and sensitivity and free passes for a future trip.

“I took this case because it’s an egregious case,” said the women’s attorney, Waukeen McCoy. “This lawsuit highlights that blacks are still being treated differently in America.”

Anthony Giaccio, the Napa Valley Wine Train CEO called the women’s removal “a 100 percent customer service fail on our part” just in case of you closeted racists and new types are accusing the women of race-baiting.

Jessica Alba Stays Cool on TV as The Honest Company Hit With Second Lawsuit

As any actor knows, the show must go on. Jessica Alba’s The Honest Company has been hit with a second class-action lawsuit filed by a consumer, but Alba managed to stay on message in two television appearances this week. The latest suit alleges (again) that Honest’s SPF 30 sunscreen was ineffective, and consumers are seeking an injunction and unspecified general and punitive damages.
Alba appeared twice on national television to promote the Sept. 9 launch of Honest Beauty, but also addressed the sunscreen situation.
Appearing Wednesday on “Extra,” she said, “It pains me that anyone doesn’t have an incredible experience with Honest Company….What we have learned is that we need to do a better job at educating, and so next year they are going to launch a safe sun education platform around sunscreen and the difference between chemical and mineral sunscreens, and the importance of reapplication and how to apply.”
Thursday on “Good Morning America,” host Amy Robach brought up the company’s recent woes, but gave Alba an out, saying “You’ve put out statements to those already,” before asking her what she wanted to say to fans.

Reps For Chris Brown Call San Jose Shooting Lawsuit “Frivolous”

Chris Brown is facing a new batch of legal drama but this time around, the R&B superstar isn’t easily copping to the blame.

Publicists for the 26-year-old singer are telling Hip-Hop Wired that although the January 11 San Jose shooting was indeed unfortunate, the days of their client being unfairly targeted by lawsuits is coming to an end.

“It is a poor reflection of our society that violence is so prevalent and it is always a tragedy when someone is physically harmed. However this is a completely frivolous lawsuit,” Breezy’s reps say in a statement.

“We expect that the case will be dismissed and in future, to avoid these reoccurring meritless lawsuits directed at Chris Brown, we plan to seek damages from all parties and their lawyers.”

Paul Briley, 22, was one of five people who were shot while attending the private “Chris Brown’s Capricorn Bash” at the Fiesta Nightclub on Monterey Highway. He recently filed a lawsuit citing negligence on the singer’s part, claiming his celebrity brings violence everywhere he goes and his security could have been a lot tighter. His legal team also inexplicably threw the Rihanna incident in the melee.

Briley is asking for unspecified damages for mental anguish, time missed from work and more.

Jay Z Asks Judge To Ignore His Riches & Rap Sheet In “Big Pimpin” Lawsuit

The long-delayed “Big Pimpin” lawsuit is finally set to be underway and defendant Jay Z is taking no chances when it boils down to coming out-of-pocket (more than he’s supposed to).

TMZ is reporting that the megastar rapper born Shawn Carter is asking a judge to disallow the future jury from glancing into his finances and his criminal history in order to have their opinions being swayed as the case develops.

To backtrack for those not in the know, the sampled foundation behind Jay Z and Timbaland’s 1999 smash hit was a 1960s Egyptian song titled “Khosara Khosara,” and the artist’s heir, Abdel Halim Hafez, is claiming the Hip-Hop pair not only infringed on the copyright of the record, but lyrically used it in a demeaning way. The case has been eight years in the making and will finally go to court in October, where Jay Z is expected to testify.

Carter, easily one of the most successful–commercially and financially–Hip-Hop artists to ever grace a mic, values at net worth of $ 550 million according to a very recent Forbes report. Allowing a prosecutor to paint the picture that he got rich stealing from unknown artists would spell a certain doom for the case. On the contrary, the plaintiff is claiming that since Jay Z “stole” the “Big Pimpin” sample, his criminal past is very much on the table here.

We’re guessing an out-of-court settlement is also out?

Dr. Dre & Ice Cube Want Off Suge Knight Hit-And-Run Lawsuit

Before Straight Outta Compton rose to a historic box office weekend, there was Suge Knight killing Terry Carter nearby the set of a promotional video spot used to promote the film.

Although N.W.A members Dr. Dre & Ice Cube were on location, they feel their presence did not give just cause to Suge Knight’s behavior and they both have filed motion to get their names removed from the wrongful death lawsuit.

Via The Hollywood Reporter:

The lawsuit against those involved with Straight Outta Compton alleges that the defendants should have known about the tensions between Dr. Dre and Knight and should have made security provisions to create a safe environment. It’s also alleged that Dr. Dre and Cube are vicariously liable for Sloan’s conduct.

In a demurrer filed last week, Dr. Dre and Cube say they committed no malfeasance, that their only affirmative act was a “specific request” that Sloan direct Knight to leave camp. This, they say, “did not create undue risks for anyone, let alone Carter.”

The two also say they owed no duty to Carter, that Knight’s assault wasn’t foreseeable, and raise the prospect of what might have happened if they allowed Knight to stay at base camp.

According to their motion, “These allegations plainly demonstrate that allowing Suge to remain at the base camp posed a serious risk that Suge could have injured someone at the camp — including Dr. Dre, Bone or one of the numerous cast and crew working on the film. Certainly, the risk that Suge might leave the base camp and proceed to his fatal confrontation with Carter was no more foreseeable than the possibility that Suge would injure or kill someone else if he had been permitted to stay.”

The former N.W.A members represented by attorney Alexander Cote say that there’s no proximate cause connecting their actions to Carter’s fatality, and argue that public policy and common sense can’t possibly demand “tolerating the presence of a dangerous and violent criminal with a grudge.”

Suge Knight is currently awaiting trial for murder of Carter and attempted murder of Sloan.

Lalani declined to comment Tuesday, deferring a request to her attorney Brett Cohen at Leeds Brown Law. Cohen did not immediately respond to a request for comment. Dame Dash Asks Judge To Toss Loisaidas Lawsuit

Damon Dash isn’t letting the recent Loisaidas movie lawsuit go away without a fight. Dash and Kanye West were swept up in a lawsuit filed earlier this year, and this month the entrepreneur asked the judge in the case to throw out the case over the use of the Loisaidas name for the film.

The term “Loisaidas,” a slang term for the Lower East Side of Manhattan, is also the name of a band fronted by Michael Medina, who trademarked the name. Medina filed suit again tWest and Dash, who serve as executive producers for the movie, last spring. Dash countered Medina’s legal jab on Aug. 4, and he’s saying that Medina cannot claim the name as his own.

Dash asked a judge Aug. 4 to throw out musician Michael Medina’s case against him, which claims Dash used the term “Loisaidas” as his film title even though Medina’s group trademarked the name. Medina’s suit, which was filed in April in New York federal court, alleges Dash’s violent “Loisaidas” movie defiled Medina’s Latin music group of the same name, and has confused fans.

But Dash said his decision to use “Loisaidas” was protected by the First Amendment. Dash also said “Loisaidas” – a Spanish slang term for people from the Lower East Side of Manhattan – can’t be owned by anyone because it’s a common word.

“Plaintiff cannot commandeer and monopolize a term that, as Plaintiff admits, is a common part of local “Spanglish” vernacular and prevent others from using that term,” Dash’s lawyer’s said in his answer to Medina’s suit. “In particular, “Loisaidas” has been used for over 40 years to identify residents who live in the Lower East Side…”

Dash also wants Medina to pay his legal fees connected to the ordeal.

Judge Orders Bill Cosby To Give Sworn Deposition In Lawsuit

 

LOS ANGELES, Aug 5 (Reuters) – Bill Cosby has been ordered to give a sworn deposition in a lawsuit brought by a woman accusing the comedian of plying her with alcohol and sexually abusing her at the Playboy Mansion in Los Angeles when she was 15 years old.

It marks the first time Cosby, 78, has been directed to testify under oath in response to a complaint of sexual misconduct against him since a deposition he gave in a separate Pennsylvania case he settled out of court nine years ago.

The latest order, made public on Wednesday, a day after a Los Angeles Superior Court judge entered it, requires Cosby to submit under oath to questions from the lawyer of his Los Angeles accuser, Judy Huth, on Oct. 9. Now in her 50s, Huth must likewise answer questions from his attorneys on Oct. 15.

Huth gained somewhat of a tactical advantage from the judge’s decision compelling Cosby to go first.

The precise times and places were not revealed, but Huth’s lawyer, Gloria Allred, has said she expects to depose Cosby in Massachusetts, where he resides.

The way for the depositions, a key part of the discovery process in civil litigation, was cleared when the California Supreme Court last month denied Cosby’s petition to review the case, dealing a final blow to his efforts to fend off Huth’s lawsuit.

Her complaint, brought in December 2014, charged that Cosby sexually abused her by putting his hand down her pants and then “taking her hand in his hand and performing a sex act on himself without her consent.”

Huth alleged the encounter occurred days after she and a female friend met Cosby at a park where he was filming a movie. According to her account, Cosby invited the girls the following weekend to his tennis club, where they all had drinks together before he led them on to the Playboy Mansion.

Cosby’s attorney Martin Singer has called Huth’s allegations false and “defamatory.”

Huth is one of more than 40 women who have come forward in the past year to say that they were raped or molested by Cosby after he gave them alcohol or drugs in incidents dating back decades.

In 2006 Cosby reached a confidential settlement for an undisclosed sum with a former Temple University employee, Andrea Constand, who accused him of sexual assault. Parts of the deposition he gave in that case were made public last month.

Huth’s complaint is one of at least four pending civil suits against Cosby stemming from such accusations.

However, Allred has said Huth’s is the only one seeking damages for the alleged misconduct itself, citing repressed psychological injuries that she claims were only discovered in the last three years, and therefore are allowed under the statute of limitations.

The other plaintiffs are suing for defamation instead.

Cosby has never been criminally charged. He and his lawyers acknowledge marital infidelity on his part but have consistently denied allegations of criminal wrongdoing. (Editing by Sandra Maler, Eric Walsh and Ken Wills)

Suge Knight, Ice Cube And Dr. Dre Hit With Wrongful Death Lawsuit

The family of Terry Carter has filed a wrongful death lawsuit against Suge Knight, Dr. Dre and Ice Cube, TMZ reports. Carter’s wife and children filed the lawsuit claiming that Cube and Dre hired gang-affiliated security for protection while filming in rough L.A neighborhoods.

In the suit, the Carter family claims that some of those gang members started a fight and threatened Knight, which led to him retaliating and coming through the Tam’s Burger’s parking lot, killing Carter. Tam’s Burgers is named in the lawsuit as well due to the family feeling that since criminal activity occurs there regularly that there should have been security on the premises.

Knight, who is facing murder and hit-and-run charges in Carter’s death, is due back in court on July 7th .

EXCLUSIVE: Turk Subpoenas Universal Music Group In Lawsuit Against Cash Money

(AllHipHop News) Tab “Turk” Virgil has already claimed one victory in his attempt to earn back royalty and publishing payments from Bryan “Birdman” Williams and Ronald “Slim” Williams’ Cash Money Records. The New Orleans rapper won a default motion against his former label earlier this month.

Turk is now seeking information from Cash Money’s parent company Universal Music Group to help determine how much he should be rewarded from the suit.

According to a source with firsthand knowledge of the case, Turk’s legal team has issued subpoenas to UMG and Universal Music Publishing Group in order to get access to accounting on the artists’ master recordings and publishing connected to Cash Money.

In the original court documents, Turk requested at least $ 1.3 million, but the judge could award him a higher amount. It is suspected Cash Money owes Turk payments regarding over 100 recordings with the imprint. The parties are scheduled to return to court in July.

Between 1997 and 2001, Turk released several singles as a member of Cash Money’s Hot Boys including “We On Fire” and “I Need A Hot Girl.” It is estimated the group has sold over 2 million albums to date.

As a solo artist, Turk released his debut studio album Young & Thuggin’ via Cash Money. He also appeared on records by other CMR acts Juvenile, Lil Wayne, and Big Tymers.

AllHipHop.com contacted representatives of Universal Music Group and Universal Music Publishing Group. As of press time, UMG declined to comment and UMPG has not responded to the matter. Turk and his attorney Patrick Costello declined to comment on this story.

Jay Z Wins Lawsuit Against Former Roc-A-Fella Engineer

Jay Z emerged victorious after a nearly one-year legal debacle with his former engineer.

According to The Hollywood Reporter:

Jay Z and Roc Nation have prevailed in a lawsuit from Chauncey Mahan, a sound engineer who participated in the recording of Vol 3… The Life and Times of S. Carter, which produced hit tracks like “Big Pimpin,” “Do it Again” and “Things That U Do.”

Mahan’s lawsuit came to a New York federal court in July 2014 after a dramatic episode.

After working with Jay Z in the late 1990s, classified as an independent contractor, Mahan kept masters, outtakes, and other unpublished material on his harddrive. Mahan says in 2000, he let executives at Roc-A-Fella know he was in possession of this material, but never received a response.

Then in 2014, Mahan claims that a “sting operation” was the tail end of Roc Nation’s request to meet at his storage facility in Los Angeles. He alleges that Jay Z’s reps called the Los Angeles Police Department to seize the music and accused him of being in possession of stolen property, but only after cataloging the inventory.

Mahan wasn’t charged with a crime, but he would then hit back with a lawsuit that sought a declaratory judgment under the Copyright Act that thanks to his original contributions and particular work status, he should be deemed a co-owner on 41 sound recordings.

On Wednesday, U.S. District Judge Lorna Schofield came back with an analysis of those claims, determining that Mahan had come to court too late.

Schofield gave three reasons why Mahan was time-barred from pursuing co-ownership: Roc-A-Fella’s registrations with the United States Copyright Office, the Albums’ packaging, and the absence of royalties all gave Mahan constructive notice or a reason to know of his injury well before he filed a lawsuit.

“Plaintiff asserts that a reasonable person would not necessarily have reason to know that royalties were owed to him in this situation,” writes the judge. “Considering the depth of Plaintiff’s experience in the music industry and the substantial commercial success of the Albums, this assertion strains credulity.”

Mahan’s argument that the statute of limitations only begins upon an express repudiation finds no favor with the judge nor the theory that the label’s copyrights to the albums didn’t necessarily mean it was the exclusive copyright holder for each and every song. Then, there’s the unpublished material. “Roc-A-Fella correctly asserts… that it owns the copyrights to the unpublished works as ‘derivative’ or ‘underlying’ parts of the Albums,” writes the judge.

Mahan also strikes out in an additional claim that Jay Z and his crew committed conversion and trespass to chattels — essentially stole — the masters, outtakes, and other unpublished material on his harddrive via the allegedly “sham” LAPD sting.

The judge finds that whatever Jay Z’s reps told to the cops — true or not — the communications were privileged. The judge notes there are other remedies to filing a false police report such as criminal prosecution for perjury. Almost needless to say, the LAPD has made no noise that it’s investigating the hip hop entrepreneur.

Mahan was represented by James Freeman. The defendants were repped by Andrew Bart at Jenner & Block.

Lil Wayne Drops $51 Million Lawsuit Against Cash Money

Melissa Rivers Files Lawsuit In Mother Joan Rivers’ Death

NEW YORK (AP) — While Joan Rivers lay sedated in a Manhattan clinic, her doctors performed unauthorized medical procedures, snapped a selfie with the comedian and failed to act as her vital signs deteriorated, according to a malpractice lawsuit filed Monday by her daughter, Melissa.

The 81-year-old comedian and star of “Fashion Police” on E! died Sept. 4, days after she went in for a routine endoscopy at Yorkville Endoscopy on Manhattan’s Upper East Side and stopped breathing.

The lawsuit filed in Manhattan State Supreme Court paints a picture of a careless, cocky staff of doctors who ran roughshod over Rivers while she was unconscious, and it suggests that she died because of their incompetence. The suit seeks unspecified damages.

Melissa Rivers said in a statement that filing the lawsuit was one of the most difficult decisions she had to make.

“What ultimately guided me was my unwavering belief that no family should ever have to go through what my mother, Cooper and I have been through,” she said, referring to her son. “The level of medical mismanagement, incompetency, disrespect and outrageous behavior is shocking and frankly, almost incomprehensible.”

She said her mother deserved better.

The city’s medical examiner found that Joan Rivers died of brain damage due to lack of oxygen after she stopped breathing during the endoscopy. Her death was classified as a therapeutic complication. The classification is not commonly used; more deaths are certified as accidents, homicides, suicides or natural causes. Negligence was not suspected. Had it been, it would have been listed as a contributing cause.

A statement from Yorkville said it wasn’t appropriate to comment on the lawsuit.

“The Rivers family has, as it has always had, our deepest sympathies and condolences,” the statement said. “The 51 physicians, nurses and staff who currently work at Yorkville remain firmly committed to providing the highest quality of care to their patients.”

The lawsuit alleges that the doctors mishandled the endoscopy and performed another medical procedure called a laryngoscopy on Rivers’ vocal cords without consent. When the anesthesiologist expressed concern over what the procedure would do to Rivers’ ability to breathe, she was told she was being “paranoid” by the gastroenterologist performing the endoscopy, Dr. Lawrence Cohen, the suit said. He has since resigned.

Rivers’ private ear, nose and throat specialist, Gwen Korovin, was introduced as an observer in the operating room but instead performed two procedures though she wasn’t cleared to work at the clinic, the lawsuit said. Rivers crashed during the second — after Cohen snapped pictures of Rivers, and with Korovin, saying later he thought Rivers would want to see them, the suit said. Korovin then left the operating room to avoid being caught, according to the suit.

A message left with Korovin’s attorney wasn’t returned. Calls to her office and Cohen’s office and home rang unanswered.

“To put it mildly, we are not just disappointed by the acts and omissions leading to the death of Joan Rivers, but we are outraged by the lack of care and concern for Ms. Rivers on the part of her treating physicians and the endoscopy center where the treatment was rendered,” said Melissa Rivers’ attorneys, Jeffrey Bloom and Ben Rubinowitz.

An investigation ordered by the federal Centers for Medicare and Medicaid Services found the clinic made several errors, including failing to keep proper medication records and snapping the cellphone photos. It also found the clinic failed to get informed consent for every procedure performed and failed to record Rivers’ weight before the administration of sedation medication.

The clinic submitted a lengthy plan for fixes, but the changes weren’t good enough and the federal agency said it would revoke accreditation unless the clinic was in better compliance by March 2. Yorkville said it was working with the agency.

Justin Bieber’s Team Insist Calvin Klein Ads Weren’t Photoshopped, Threaten Lawsuit

Justin Bieber was recently revealed as the new Marky Mark, a.k.a. the new face of Calvin Klein. But now there are claims that the photos of a bulky Biebs in his underwear were Photoshopped.

Website BreatheHeavy.com released the allegedly unretouched photo of Bieber as a GIF, which suggests that his muscles, bulge and hands have been increased in size. An image from a behind-the-scenes video also shows him with less body hair than in the official ads.

Bieber’s team has denied any use of Photoshop on the ads, according to a letter obtained by TMZ claiming that the photo from BreatheHeavy is fake. His team also apparently sent BreatheHeavy a cease-and-desist letter, requesting them to remove the GIF and admit to falsehood. The website has since responded, deleting the image from Instagram, apologizing to Bieber and retracting their claims in the following statement:

Team Bieber sent BreatheHeavy a cease and desist letter because of the alleged un-retouched Calvin Klein photo we posted, asking we remove the picture in question as well as provide a retraction.

Because BreatheHeavy is not about making anyone feel bad or intentionally stirring the pot (and are definitely not here for lawsuits), we shall retract the story per request.

We sincerely apologize to Bieber for the hit to his ego and to the millions of tweens on social media we upset.

Calvin Klein also posted a photo of a shirtless Bieber to their Instagram on Friday night with the caption, “Can’t touch this.”
